A 23-year-old Virginia Beach, Virginia, driver who’s awaiting trial for the 2008 drunken driving death of his friend will remain free on bond despite acquiring a more recent charge of obstructing justice and using profane language over a public airway.
The Virginian-Pilot reports that the determination was made by Circuit Court judge Frederick B. Lowe despite prosecutors’ request that the offender’s bond be revoked in light of his new charges.
The man is accused of leaving a threatening phone message for a witness who’s subpoenaed to testify in his retrial. A prosecutor has said that the witness feels the man intended harm, but the man’s attorney argued that he made a mistake by leaving the message but never meant to hurt anyone. The judge ruled that he didn’t have sufficient evidence to revoke bond but said he’ll rehear the matter if prosecutors can cough up more evidence.
The man is currently charged with involuntary manslaughter and drunken driving in connection with the December 28, 2008, death of his 20-year-old male friend, a former high school volleyball star. He has since been out on bond for 33 months.
A May 2011 trial regarding the matter went awry after Lowe declared it a mistrial when jurors couldn’t agree on a sentence. The man’s new trial is scheduled for November 1.

A Virginia man who was legally drunk when he blew through a stop sign and caused a fatal Easter Sunday collision was sentenced this week to seven to 21 years in prison.
The sentencing, in an Oneida County courtroom, was an emotional one, according to the Utica Observer-Dispatch.
“[My father] survived a horrible war in Bosnia, was wounded, spent days in a concentration camp,” said the victim’s daughter. “Finally, when he could enjoy his life again and enjoy his grandkids, his life was cut short by a total stranger who made the worst possible choice: to get in a car and drive after he had been drinking.”
The woman spoke to the 46-year-old man who caused the fatal crash in Utica, New York, on April 24 at the intersection of South Street and Webster Avenue. The crash also seriously injured the victim’s 47-year-old wife, whose condition prevented her from coming to court.
“I can’t imagine her suffering,” said a district attorney. “How she goes on every day, I don’t know … [She] will never have her [husband] back.”
The man earlier plead guilty to aggravated vehicular homicide, aggravated vehicular assault, and aggravated driving while intoxicated. Injured himself in the crash, the driver has taken issue with having had his blood drawn by authorities while unconscious.

A 17-year-old Chesterfield, Virginia, boy who drank as many as seven shots of tequila and then drove the wrong way down a highway, killing two people, has been convicted of aggravated involuntary manslaughter and now faces up to 41 years in prison.
The Richmond Times-Dispatch reports that the fatal collision occurred in March 2011 when the high school junior, who had a learner’s permit but not a license, got on the road around 2:30 a.m. and drove the wrong way through a Powhite Parkway Extension toll plaza at Courthouse Road. He then accelerated and began traveling north in the southbound lanes at up to 90 miles per hour.
The boy traveled the wrong way for a mile, during which time he almost collided with two cars being operated by police officers, before slamming into a BMW and killing both a 32-year-old male and 29-year-old male. One man died instantly, while the other died before paramedics arrived on the scene.
“I think the most aggravating factor was that he didn’t even realize he was involved in a (fatal) accident,” said Assistant Commonwealth’s Attorney B.J. McGee. “He thought it was a single-car accident … and didn’t realize that he had hit, and unfortunately killed, two other individuals.”
In addition to the manslaughter charge, the teen was charged with drunk driving and will be sentenced on December 5. He will serve a minimum of a year in jail on each manslaughter count, but could be imprisoned for as long as four decades.

A Newport News, Virginia, man was burned on the job on Tuesday, August 9, while working on the roof of a church.
HamptonRoads.com reports that the man suffered an electrical burn around 10 a.m. when he came into contact with an electrical line that powered a rooftop air conditioning unit. The man — an employee of Hampton, Virginia-based Tidewater Roofing Company — was helping to repair the roof of Saint Paul AME Church on 2500 Chestnut Avenue.
The Newport News Fire Department used an aerial tower ladder from one of their trucks to bring the worker safely down to the ground — blocking thru traffic on Chestnut and 26th Street for 30 minutes.
The victim was transported to Riverside Regional Hospital with non-life-threatening injuries. His name has not yet been released.

A Norfolk, Virginia, police officer who fatally injured a bicyclist a year ago was fined and sentenced to community service on Friday, July 22.
The accident occurred around 1 a.m. on July 25, 2010, when Officer Derek Folston was speeding to reach a non-emergency call and struck a bicyclist on the 1500 block of Brambleton Avenue. The collision caused the cyclist severe injuries from which he died two months later.
Fox43TV.com reports that the bicyclist had a blood alcohol level of .20 when he was hit.
Folston and another officer in a separate cruiser had both been speeding to reach the Tidewater Gardens area over the Campostella Bridge. Court records revealed that neither had lights or sirens turned on, and Folston admitted to driving 20 miles over the speed limit. Both officers have been on administrative duty since the accident.
Convicted earlier this month of misdemeanor reckless driving, Folston was fined $1,000, sentenced to 100 hours of community service, and had his license suspended for 60 days. Judge Jerrauld C. Jones suspended a six-month jail sentence, The Virginian-Pilot reports.

A worker died in an accident that occurred Wednesday, July 13, while he was on the job at Tapscott Brothers Logging near Scottsville, Virginia–about 70 miles west of Richmond.
According to The Daily Progress, the 56-year-old victim was pinned between a forklift and another piece of machinery.
Lieutenant Aaron C. Hurd of the Fluvanna County Sheriff’s Office said the man was declared dead at the scene of the accident at Rolling Road South in Fluvanna County.
Rescue officials from both Fluvanna County and Scottsville arrived to help, as did several deputies.
Officials said that an autopsy will be conducted on Monday, July 18, because the man died in a work-related accident.
According to TimberLine Magazine, Tapscott Brothers Logging was founded in 1983.

A 33-year-old man from Cincinnati, Ohio, died Sunday night after falling from a balcony at the Virginia Beach, Virginia, Oceanfront hotel where he was staying. His death follows the death of a toddler who, just two days earlier, also died after falling from an Oceanfront hotel balcony in Virginia Beach.
Just after 9 p.m., the man fell from a ninth-floor balcony at the Four Sails hotel at the 3300 block of Atlantic Avenue and was pronounced dead at the scene. He was staying at the hotel with his wife and three children.
Police spokesman Adam Bernstein told WTKR that foul play was not suspected in the death and that it hasn’t yet been determined whether the man jumped or fell from the balcony. He also told WAYTV that alcohol is “definitely a factor in this case.”
This death follows a similar Virginia Beach tragedy. On Friday, a two-year-old girl from Staunton, Virginia, fell five stories through the balcony railing at the Sandcastle Oceanfront Resort in Virginia Beach. The toddler slipped through a six-inch gap between the bars of the balcony railing and hit a canvas awning before landing on a patio outside a restaurant. She died the following morning at Norfolk General Hospital.
Newsleader.com reports that state building codes updated in 2009 state that balconies should allow no more than four inches between bars on a railing but that because this hotel was built in the ’60s it didn’t have to adhere to those codes.

Richmond Times-Dispatch reported an 18-year-old driver was involved and killed in a Virginia auto accident early Sunday morning.
The driver was driving his Ford Ranger pickup truck when he ran off the road and caused the Virginia auto accident.
The driver of the Virginia car accident overcorrected his truck and lost control of it when it overturned. He was not wearing his seat belt and was killed when he was ejected from the truck.

A Virginia auto accident claimed the life of a motorcyclist Wednesday night after he sped from police, according to the Daily Press.
Reports say the 40-year-old Virginia car accident victim was pulling alongside police cars then drifting back and sped away when police attempted to pull him over for his erratic driving.
The driver clipped the fender of a truck after he sped away, lost control, and crashed into a tree, where he was pronounced dead at the scene of the Virginia auto accident.
